Notaries Refusal to Perform Notarial Acts:
Notaries have the authority to refuse to perform a notarial act under the following circumstances
- If the notary isn't satisfied that the individual executing the record is competent or has the capacity to execute the record.
- If the notary isn't satisfied that the individual’s signature is knowingly and voluntarily made
- If the notary isn't satisfied that the individual’s signature on the record or statement substantially matches the signature on the identification used to confirm their identity
- If the notary isn't satisfied that the physical appearance of the individual signing the record or statement substantially matches the photograph on the form of identification used to confirm the identity of the individual, notaries can require an individual to provide additional information or identification credentials we deem necessary to feel confident of their identity.
- Refusal to perform a notarial act based upon a customer’s race, color, national origin, religion, sexual orientation, gender identity (including pregnancy), disability, or marital status reasons is prohibited by law
The law defines acceptable forms of identification as:
- Passports (issued by the United States or a foreign government as long as the language is understood by the notary)
- Drivers License (issued by a state of the United States, by a state or territory in Canada or Mexico)
- Government-Issued nondriver ID (issued by the United States, a state or territory in Canada or Mexico)
- Social Security card
- Military ID
We are not lawyers - A notary public is a certified official recognized by law to perform certain legal formalities, especially to certify documents, administer oaths, and witness signatures. However, a notary public is not a lawyer. They do not have the authority to give legal advice, draft legal documents, or represent individuals in legal matters. Their main role is to ensure the integrity of the legal documents they notarize, helping to prevent fraud by verifying the identity of signers and the voluntary nature of their signatures.
